Your client had bariatric surgery in the recent past, specifically, (date). Bariatric surgery results in productive belching (PB’ing). This is a form of gastroesophageal reflux. It is due to disruption of the normal anatomy and physiology, specifically a disruption of gastric motility.
The significance of gastroesophageal reflux with respect to evidentiary breath testing is the same as that which is well studied in gastroesophageal reflux disease as discussed above. Such individuals are not suitable for evidentiary breath testing. To determine blood alcohol levels in such individuals one must obtain a blood specimen collected, handled, transported and analyzed properly. In forensic cases the analysis should be by Gas Chromatography/Mass Spectroscopy (GC/MS).
